Rest assured there is a lot of drama here and this case is far from finished.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>Johnson converted his legendary clutch play into a far more lucrative, second career, four companies under the Piston group doing roughly $3 billion a year, one of the nation\u2019s largest minority auto suppliers.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>But the Michigan Minority Supplier Development Council revoked Johnson\u2019s minority status last February claiming no minority management and adding Johnson does not manage his company\u2019s day-to-day operations.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>Minority supplier council CEO Michelle Sourie Robinson says this is a simple case.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>In a statement she said, \u201cThis is not about any one company or person. In an era where society is openly declaring its commitment to social, racial and economic diversity and inclusion, it is imperative that we all play by and not bend or break the rules established to ensure a fair shake for those who have been historically left out.\u201d<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>Johnson\u2019s attorney Cinnamon Ploska disagrees that\u2019s what is at play here.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>\u201cIt\u2019s offensive to suggest a narrative he\u2019s not managing these companies and he\u2019s not behind his brand doing everything necessary to grow these companies,\u201d said Ploska.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>Instead she says Robinson had a personal problem with Johnson.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>She claims Robinson wanted Johnson to fund her organization and got angry when he hired one of her staffers.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>\u201cIn addition to not donating $300,000 to MMSDC and supporting a golf outing, Johnson did hire an employee of MMSDC and that obviously agitated her,\u201d said Ploska.<\/strong><\/p>\n<p class=\"Text__BaseText-mmkwcw-0 dRMzTN\"><strong>Former MMSDC staffer Frank Ervin now runs the government relations department at Piston Group.<\/strong><\/p>\n<h2 class=\"h-custom-headline cs-ta-left h-resp-alt mvn h2\">We Are Piston Group, VINNIE HAS BUILT A GREAT COMPANY.<\/h2>\n<div class=\"lede-wrap\">\n<div class=\"lede-text-v2 lede\">\n<div class=\"lede-text-v2__container\">\n<div class=\"lede-text-v2__content\">\n<div class=\"eyebrow-v2\"><strong>Corporate Leadership<\/strong><\/div>\n<div>\n<h6 class=\"h-custom-headline cs-ta-center h-sup h6\">Who We Are<\/h6>\n<h2 class=\"h-custom-headline cs-ta-center h2\">Building Value<\/h2>\n<div class=\"x-text cs-ta-center\">\n<p><strong>Piston Group wasn\u2019t just founded to make things. The Piston Group hadn\u2019t replaced its outgoing chief financial officer, who is Asian, with a person of color, leaving its 11-person executive team devoid of any minorities, except Johnson, who is the chief executive and chairman, and its government affairs director, who is Black. The council argues Johnson is not involved in the day-to-day operations of the company, either, another requirement for certification.<\/strong><\/p>\n<p class=\"paywall\"><strong>Johnson disagrees\u00a0and in a lawsuit filed last month\u00a0counters\u00a0that the council has been arbitrary and opaque in its dealings with him.\u00a0 The MMSDC has used \u201cunfettered discretion and secrecy to wrongfully punish Piston Group and the Piston Companies due to a misunderstanding of Mr. Johnson\u2019s role or personal differences with him,\u2019\u2019 he argued in the suit. Johnson declined to comment.<\/strong><\/p>\n<p class=\"paywall\"><strong>On Monday, a judge approved the Piston Group\u2019s request for an injunction and temporary reinstatement of its minority certification while the case continues. The ruling found MMSDC had not provided enough evidence to support its claims beyond \u201cunspecified customer complaints,\u201d Judge David Groner of Michigan&#8217;s Third Judicial Circuit wrote in his decision Monday. He also added that the evidence favors Johnson\u2019s version of events.<\/strong><\/p>\n<p class=\"paywall\"><strong>\u201cWe are delighted by the court\u2019s decision today,\u201d the Piston Group said in a statement Monday.\u00a0\u201cWe will continue efforts to vindicate Mr. Johnson.\u201d\u00a0<\/strong><\/p>\n<p class=\"paywall\"><strong>The MMSDC didn\u2019t\u00a0immediately have a\u00a0comment on the ruling, but has previously said the lawsuit has no merit and that it requires all companies to meet the same basic criteria: at least 51% ownership by a minority, active minority management in day-to-day operations, and operational independence.\u00a0<\/strong><\/p>\n<p class=\"paywall\"><strong>The simmering conflict\u00a0has erupted into a debate over the nature, purpose and scope of minority set-aside programs, which were created to chip away at America\u2019s racial wealth gap.\u00a0Johnson advocates argue he\u2019s being penalized for success, and the certification standards need to be adjusted for a company the\u00a0size of his. Since then, the programs\u00a0have evolved to include spending targets,\u00a0mentoring, and joint ventures between global suppliers and smaller\u00a0firms. Some automakers\u00a0have\u00a0even spun out pieces of their own company\u00a0for minority ownership.\u00a0<\/strong><\/p>\n<p class=\"paywall\"><strong>Automakers rightly take credit for pioneering the programs, which have directed hundreds of billions of dollars toward minority-owned businesses and minted a generation of successful entrepreneurs of color. But they have limitations. While the number of eligible groups has expanded to include women, veterans and LGBTQ people, the size of the procurement pie hasn\u2019t, several Black auto executives said.\u00a0 When a minority-owned company forms a joint venture with a global auto supplier, it can help the business scale dramatically, but there\u2019s a ceiling to that growth \u2014 taking outside capital means sharing financial control and forfeiting minority certification. If a minority owner wants to sell the company, they can only sell to another minority, or risk losing preferential status with automakers.<\/strong><\/p>\n<p class=\"paywall\"><strong>\u201cI don\u2019t want to bite the hand that feeds me, but I do think there are systemic problems or limitations on the way we do things,\u201d said Ron Hall Jr., chief executive officer of Bridgewater Interiors, a seating manufacturer started by his father to supply GM in 1998. \u201cThere\u2019s a growing challenge, just born of time, and succession planning at companies, and rolling them from one generation to another.\u201d<\/strong><\/p>\n<p class=\"paywall\"><strong>Unlike many minority entrepreneurs, Johnson began his automotive career with a substantial amount of financial and social capital. Meanwhile, Johnson\u00a0forged relationships with top auto executives,\u00a0 golfing with former Ford CEO Alan Mulally, and acquiring a unit of\u00a0troubled airbag maker Takata Corp. in a deal executives from Ford and Fiat Chrysler Automobiles NV helped broker.\u00a0\u00a0<\/strong><\/p>\n<p class=\"paywall\"><strong>Today, the company employs <a title=\"Piston Group presentation\" href=\"https:\/\/www.pistongroup.com\/wp-content\/uploads\/2018\/08\/PG-Company-Overview-Customer-Presentation_2021-1.pdf\" target=\"_blank\" rel=\"nofollow noopener\">more than 11,000<\/a> people in Michigan, Ohio, Illinois, Kentucky and Missouri, and Mexico.<\/strong><\/p>\n<p class=\"paywall\"><strong>As Johnson grew his empire using\u00a0his minority supplier status, he periodically had issues complying with\u00a0the designation\u2019s requirements because of the\u00a0lack of minorities involved in day-to-day management, the MMSDC said in a legal filing.\u00a0 In business meetings and at trade shows, customers and competitors have long noted how White the top ranks were \u2014 an anomaly among minority-owned suppliers, according to five\u00a0people employed by former customers and competitors, who asked not to be named publicly.\u00a0<\/strong><\/p>\n<p class=\"paywall\"><strong>The company counters that it\u2019s been \u201cproactive\u201d in hiring and promoting minorities\u00a0and has a\u00a0plan for increasing diversity in\u00a0leadership.\u00a0<\/strong><\/p>\n<aside class=\"pullquote paywall\" data-align=\"center\">\n<p class=\"passage\"><strong>\u2018Our policies are not designed to create wealth for one\u2019<\/strong><\/p>\n<\/aside>\n<p class=\"paywall\"><strong>The MMSDC has been nudging Johnson\u00a0to diversify his executive ranks,\u00a0it said in court filings.\u00a0Tensions boiled over in February, when the nonprofit, whose governing board includes executives from Stellantis,\u00a0Ford, GM\u00a0and Toyota Motor Co.\u00a0stripped the Piston Group of its certification, jeopardizing as much as $2.5 billion worth of business, the company claims in its lawsuit. Ford and Stellantis make up 75% of the Piston Group\u2019s sales, the lawsuit claims.\u00a0<\/strong><\/p>\n<p class=\"paywall\"><strong>A Ford spokesperson said the company doesn\u2019t comment on litigation not related to Ford. Stellantis declined to comment on the Piston Group, but pointed to the $90 billion it has spent with diverse suppliers. GM said it supports the MMSDC, but will continue to do business with the Piston Group regardless of its certification status. It accuses Robinson of moving the goal posts on certification to punish Johnson,\u00a0demanding that he replace one of his top lieutenants, who is\u00a0White, with a minority, and keeping the company in the dark about the metrics used to decertify it. The MMSDC denies it\u00a0demanded the removal of executives.<\/strong><\/p>\n<aside class=\"left-rail-newsletter paywall\"><\/aside>\n<p class=\"paywall\"><strong>\u201cIf the MMSDC is permitted to conduct its business in an arbitrary and malicious manner, without regard to standards, and in a way that targets companies and individuals based on personal vendettas, the validity of all diversity initiatives and programs are at risk,\u201d Johnson\u2019s lawsuit states.<\/strong><\/p>\n<p class=\"paywall\"><strong>Louis Green, a former president of both the MMSDC and the National Minority Supplier Development Council in New York, said the certification process is intentionally opaque in order to prevent fraud.<\/strong><\/p>\n<p class=\"paywall\"><strong>\u201cThere are people who make a front company, put a woman or minority at the front to get the contract,\u201d said Green. \u201cI would liken it to IRS auditors who have a handbook of things they need to look for when somebody may be trying to fool the government about taxes. They don\u2019t make that public.\u201d<\/strong><\/p>\n<p class=\"paywall\"><strong>John Taylor, a professor of supply-chain management at Wayne State University in Detroit, said the Piston Group is big enough to compete without minority designation as long as it remains competitive on cost and quality. Small suppliers will still follow the MMSDC\u2019s rules, because they need the support, he said.<\/strong><\/p>\n<p class=\"paywall\"><strong>A court hearing for Johnson\u2019s case is scheduled for Sept. 2.
